This is the story of a mother named Bina, who is fighting for a better future for her son Muhammad Rehan despite physical disability. Bina was married to Raja Muhammad, and they had a son. After some time, their relationship started to deteriorate, and eventually, Bina obtained a divorce. One of the conditions in the divorce agreement was that Bina would not claim custody of her son, after which Raja Muhammad retained the custody. However, Bina objected to this decision and did not want to give up her right to love and care for her son. Therefore, she approached the Family Court to gain physical custody of her son.

یہ کہانی بینا نامی ایک ماں کی ہے، جو جسمانی معذوری کے باوجود اپنے بیٹے محمد ریحان کے بہتر مستقبل کے لیے لڑ رہی ہیں۔ بینا کی شادی راجہ محمد سے ہوئی تھی، اور ان کا ایک بیٹا تھا۔ شادی کے کچھ عرصے بعد، ان کے درمیان تعلقات خراب ہونے لگے، اور آخر کار بینا نے خلع حاصل کیا۔ خلع کے معاہدے میں ایک شرط یہ بھی تھی کہ بینا اپنے بیٹے کی تحویل کا دعویٰ نہیں کریں گی، جس کے بعد راجہ محمد نے بچے کی تحویل برقرار رکھی۔

Mother’s Lawyer’s Arguments

Bina’s lawyer, Ms. Jamila Jehan Noor Aslam, presented strong arguments in favor of Bina in court. She argued that the custody condition in the divorce agreement is illegal according to the law. According to her, under Islamic laws, a mother has the right to custody, and she cannot be deprived of this right. After hearing arguments from both sides, the court examined the issue in the light of Islamic laws, constitutional principles, and custody laws. The court stated that under Islamic laws, the divorce agreement does not affect the child’s custody, and the mother’s right to custody remains. The court declared the custody condition in the agreement as illegal and against public interest. The court referred to Articles 9, 14, and 25 of the constitution and stated that despite disability, no individual can be deprived of their rights. The mother’s physical disability does not affect her right to custody, and she should be given the right to raise and love her child.
